The Committee on Legislative Support of law Enforcement recommends that the Verkhovna Rada should adopt as a basis the draft law on amendments to several legislative acts of Ukraine re implementation of provisions of the Criminal Procedure Code of Ukraine

The bill (Reg. No. 4712) stipulates amending the Criminal Code, the Code of Ukraine on Administrative Infringements and the Criminal Procedure Code aimed at “providing legal support to protection of rights and freedoms of a person and citizen, as well as ownership, public order and safety, environment and constitutional form of governance of Ukraine against illegal criminal encroachment; maintaining peace and safety of humanity; and preventing criminal offences.” 
The bill suggests introduce the notion of “criminal offence” in the Criminal Code that would encompass all criminally punishable acts that are subdivided into crimes and criminal infractions.

Particularly, the document stipulates “transfer” several actions being classified as administrative offences, and included in the Code of Ukraine on Administrative Infringements, into the Criminal Code and grant them the “status” of criminal infractions.

It was noted that the bill aims at implementation of state policy on humanization of criminal responsibility that shall result in a significant reduction of the number of convicted and imprisoned persons.

Having analyzed the bill, Committee members deem its adoption topical. The believe that this will help bring Ukrainian legislation in line with the practice of the European Court of Human Rights with consideration of experience of the Western and Eastern Europe, and will establish an efficient system of counteraction to criminal infringements, etc.
