The Committee on Transport and Communications recommends that the Verkhovna Rada adopt as a basis the draft law on amendments to article 32 of the Merchant Shipping Code of Ukraine (re the right to sail under the National Flag of Ukraine)

It was mentioned at the Committee’s meeting that the bill (Reg. No. 3294) aims at improving legislative regulation of the issue on granting ships the right to sail under the National Flag of Ukraine in the part of ensuring rights and interests of the state and the investor.   

The draft suggests establish that the right to sail under the National Flag of Ukraine will apply also to ships belonging to physical persons–economic entities and legal persons registered in Ukraine regardless of presence or absence of foreign investments in their authorized capital.  

During the discussion, the necessity of adopting the bill was justified by the fact that current version of the Merchant Shipping Code of Ukraine does not specify possibilities of providing the right to sail under the National Flag of Ukraine to ships belonging to physical persons–economic entities, or ships belonging to such persons under the bareboat–charter agreement.

It was also stressed that the abovementioned provisions deprive investments into shipping industry of Ukraine of attractiveness, prevent implementation of investment projects aimed at building or buying ships.  

The Committee members claimed that adoption of the bill will promote attracting additional investments, including the investments into the shipping industry, popularization of investment projects in Ukraine, etc.
