The Committee on Legislative Support of Law Enforcement recommends that the Verkhovna Rada should adopt as a basis the draft law on amendments to the Criminal Code of Ukraine re refining criminal responsibility for separate crimes against ownership and immunity of a person

The bill (Reg. No. 2581a) suggests impose criminal responsibility for illegal inspection of a person and illegal seizure of his/her property or documents. Under amendments to article 162 of the Criminal Code, “illegal entrance into person’s house or his/her other ownership; its illegal inspection or ransack; illegal eviction or other actions that violate immunity of citizens’ residence, as well as illegal check, examination or inspection of a person, or illegal seizure of person’s property or documents, -

shall be punished with a fine in the amount of fifty-one hundred citizens’ personal exemptions or corrective labour of up to two years, or custodial restraint of up to three years. 

The same actions committed by an official or with the use of force or threat of use of violence, -

shall be punished with imprisonment from two to five years.” 

The bill suggests determine the notions of “dwelling”, “lodging” and “person’s ownership”.

The people’s deputies upheld the bill, adoption of which will promote refinement of the mechanism of legal regulation of criminal responsibility for separate crimes against ownership or person’s immunity.
