It was mentioned at the Committee’s meeting that the bill (Reg. No. 4389) is aimed at securing guarantees of legal and social protection of illegally convicted persons, eliminating results of lawlessness and establishing compensation for the rehabilitated for illegal actions.
The Committee’s members suggested establish Commission on matters of rehabilitation of persons that were illegally convicted consisting of 15 persons, of which 10 are from among judges (retired judges) and 5 members of the public. Commission’s composition shall be approved by the Verkhovna Rada.
People’s deputies noted that in case the Commission recognizes presence of signs of adoption of a court decision, the person can file a law suit in court to be granted the status of a rehabilitated.
Moreover, it was mentioned that according to the bill’s provisions, in case of acquittal, the court recognizes a person rehabilitated and the latter has the right to compensation or return of a seized property.
During the bill’s elaboration for the second reading, subjects with the right of legislative initiative made several proposals and amendments.
