The Committee on the Rule of Law and Justice recommends that the Parliament should adopt as a basis the bill on amendments to the Law “On the Higher Council of Justice” (re deadlines for carrying out checks)

The bill (Reg. No. 3866) aims at setting the deadline for a member of the Higher Council of Justice to carry out record checks on the presence of grounds for dismissal of a judge due to violation of an oath; or on violation of incompatibility requirements by a judge or a prosecutor; as well as on consideration of respective proposals of members of the Higher Council of Justice during the meeting of the Higher Council of Justice.

Parliamentarians focused attention on the fact that this bill is adjusted in regard to the bill No. 3501, which the Committee recommended to recommit to the subject of legislative initiative, and which was withdrawn by the author.

The bill suggests amend articles 25 and 32 of the Law “On the Higher Council of Justice”.

In the course of consideration, the people’s deputies stressed that the Higher Council of Justice upholds provisions of the bill to establish the respective deadlines.

Apart from this, according to the opinion of the Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariat, following the results of consideration in the first reading, the bill can be adopted as a basis.

Committee members believe that adoption of the bill will optimize work of the Higher Council of Judges in the course of consideration of issues on the presence of grounds for dismissal of a judge due to violation of an oath and will also promote adherence to the principle of judges’ independence.
