The Committee on the Rule of Law and Justice recommends that the Parliament should adopt in the second reading and in entirety the draft law on restoring trust in the court system of Ukraine

The bill (Reg. No. 4378-1) aims to establish the rule of law and legitimacy in the society; restore trust in the court system of Ukraine; dismiss persons that rendered decisions aiming at restriction of constitutional rights and freedoms of citizens; and decrease corruption level in the system of courts of general jurisdiction.   

Committee members stressed that the bill suggests determine legal and organizational basis for carrying out special examination of judges of courts of general jurisdiction as a temporary, tighten-up measure with the use of existing procedures for consideration of issues on bringing judges of general jurisdiction to disciplinary responsibility, as well as their dismissal in connection with violation of oath in order to enhance authority of the court power in Ukraine, increase citizens’ trust into the court branch and restore legality and justice.

The bill proposes amend the laws “On the Court System and the Status of Judges” and “On the Higher Council of Justice”.

The Committee has refined the abovementioned bill with consideration of proposals and remarks of subjects of legislative initiative, having cut in half the deadline for submitting and consideration of such remarks and proposals.             

In the course of preparation of the bill for the second reading, 192 amendments were received from the subjects of legislative initiative. Following the results of consideration, 58 amendments were taken into account (including partially, or in a new version) and 131 amendments were rejected. Committee members split on vote and failed to take any decision on 3 amendments.  

The people’s deputies suggested a new version of part 2 of article 4 of section I of the bill.
