The Committee on Judicial Policy recommends that the Parliament should recommit the draft law on amendments to several legislative acts of Ukraine (re securing rights of certain categories of persons to court protection)

The bill (Reg. No. 3155) aims at: bringing provisions of the Civil and Civil Procedure Codes in the part of securing rights and legal interests of natural persons in line with the Constitution of Ukraine; providing persons in tutelage with the possibility to file a petition in court to release a trustee form his powers; and remove barriers for a disabled person to file a petition in court to stop applying in regard to him/her compulsory measures of a medical nature.    

The bill suggests amend the Civil and Civil Procedure Codes by stipulating the right of a person, recognized a disabled, to independently file a petition in court to cancel the decision on recognition of him/her a disabled and renew his/her civil capacity.  

In case the abovementioned amendments to the Civil Procedure Code are made, this shall cause a conflict of laws since the subject of legislative initiative does not propose amendments to clause 2 of part three of article 121 of this Code under which, a court returns the petition filed by a disabled person.
