The Committee on the Rule of Law and Justice does not uphold the draft law on amendments to article 5 of the Law of Ukraine “On Court Fee” (re social payments)

It was mentioned during the Committee meeting that the bill (Reg. No. 3113) suggests introduce a new version of clause 20 of chapter one of article 5 of the Law of Ukraine “On Court Fee.”

During the discussion, the people’s deputies voiced their remarks to the bill and stressed that suggested amendments narrow down potentialities of implementing, by social protection authorities, the function of state protection of citizens against violation of legislation regarding assignment and payment of social assistance on the part of legal entities and sole proprietors responsible for this. This contradicts to the provisions of the preamble and articles 1, 3 and 46 of the Constitution.     

Moreover, it was mentioned that exemption of state authorities from paying the court fee results in decrease of judicial authorities funding, increase of load on courts and provision of social protection authorities with some procedural advantages.     

The Committee members stressed that the Central Scientific Experts Office of the Verkhovna Rada Secretariat expressed several important remarks to the bill and opposed the exemption of state authorities from paying the court fee.
