The Committee on the Rule of Law and Justice recommends that the Parliament should adopt as a basis the draft law on amendments to several legislative acts of Ukraine re refining the procedure of execution of courts’ judgments in the interest of children

The bill (Reg. No. 3062) aims to establish legislative conditions for efficient fulfillment of its international commitments by Ukraine taken under The Hague Convention on the Civil Aspects of International Child Abduction of 1980, etc.

The bill suggests amend the Civil Procedure Code of Ukraine in order to adhere to the requirements of articles 11, 12, 13, 14, 15 and 16 of the Convention on the Civil Aspects of International Child Abduction.  

In view of the suggested amendments to the Civil Procedure Code, it is also suggested amend the Family Code in the part of handling the situation on bringing the child back and differentiating between the notions of “taking children away” and “bringing children back”.

Committee members believe that adoption of the bill will positively affect fulfillment of its international commitments by Ukraine and promote efficient protection of children’s rights and interests. Adoption of the bill will also allow refine the laws of Ukraine in the sphere of international private law and simplify the procedure of child search.
