The Committee on Judicial Policy recognized the draft law on amendments to the Law ‘On state registration of proprietary rights to immovable property and their encumbrances’ re applying for state registration of rights and their encumbrances via post as non-contradicting to the provisions of the Constitution of Ukraine

The bill (Reg. No. 3296) is elaborated in order to simplify the procedure of state registration of proprietary rights and their encumbrances, as well as to save time of persons applying for state registration.  

Particularly, it is suggested to amend the Law ‘On state registration of proprietary rights to immovable property and their encumbrances’ stipulating that application for state registration of rights and their encumbrances is submitted to state registration of rights authority in written form by an applicant personally or is sent via post with an enclosure list.      

It was stated at the meeting that the Ministry of Justice upheld the concept of the bill, but it also submitted a remark not referring to its contradiction to the provisions of the Constitution of Ukraine.
