The Committee on Judicial Policy recognized the draft law on the legal regime of common ownership property of territorial communities as non-contradicting to the provisions of the Constitution of Ukraine

The bill (Reg. No. 3260) aims to regulate mechanisms for target use of municipal property in the interests of territorial communities and determine grounds of origin, implementation and termination of the right to common ownership property of territorial communities.

Under the Constitution of Ukraine (clauses 7 and 15 of part of article 92, article 146), legal ownership regime as well as fundamentals of functioning of local self-government and other issues pertaining to organization of local self-government and activity of its bodies are determined by the law. In view of the fact that the Verkhovna Rada is the only legislative body in Ukraine, one of the duties of which is to adopt laws (article 75, clause 3 of part one of article 85 of the Constitution of Ukraine), the suggested amendments to applicable legislation correspond to the provisions of the Constitution of Ukraine. The bill is based on the constitutional and legal platform.
