The Committee on Judicial Policy recognized the draft law on amendments to article 5 of the Law “On Court Fee” re specifying provisions on exemption from payment of a court fee as non-contradicting to the Constitution of Ukraine

The bill (Reg. No. 3349) suggests exclude from article 5 of the Law “On Court Fee” the provision under which the following bodies are exempted from payment of a court fee: Antimonopoly Committee and its territorial departments; State Reserve Agency, Ministry of Justice; bodies of executive power and bodies of local self-government; Pension Fund and its bodies; bodies of the State Social Insurance Fund for Unemployment Cases; Social Insurance Fund against Industrial Accidents and Occupational Diseases; Social Insurance Fund against Temporary Disability; Fund for Social Protection of Disabled People and departments; bodies of labour and social protection of population; Ministry of Finance; local financial bodies, bodies of income and levy; State Treasury Service, State Financial Inspection and its territorial bodies; State Financial Monitoring Service and the National Bank; the authorized person of the Deposit Guarantee Fund; Ministry of Regional Development, Construction, Housing and Communal Services; as well as State Architecture and Building Inspection and its territorial bodies.

Exclusively the laws of Ukraine establish taxes and levies (clause 1 of part two of article 92 of the Constitution of Ukraine). The Verkhovna Rada is the only legislative body in Ukraine, one of the duties of which is to adopt laws (article 75, clause 3 of part one of article 85 of the Constitution of Ukraine), suggested amendments to the applicable legislation correspond to the provisions of the Constitution of Ukraine.
