The Committee on Industrial and Investment Policy deems the draft law on amendments to several legislative acts of Ukraine re preventing negative developments in the result of activity aimed at artificial change of the state of atmosphere and atmospheric phenomena requires refinement

The bill (Reg. No. 3041) suggests prohibit activity aimed at artificial change of the state of atmosphere and atmospheric phenomena with economic purposes by amending article 16 of the Law “On Protection of Atmospheric Air”. It is suggested impose criminal liability for violation of the order of performing activity aimed at artificial change of the state of atmosphere and atmospheric phenomena by excluding article 78-1 from the Code of Ukraine on administrative Infringements and by introducing a new article 241-1 to the Criminal Code.  

Experts are primarily concerned with the suggested amendments to article 16 of the Law “On Protection of Atmospheric Air”.

Experts believe that “in case there are problems with performing the respective activity, they should be settled in the sphere of law enforcement, particularly, by strengthening control over the adherence to the procedure of issuing licenses for the activity connected with artificial change of the state of atmosphere and atmospheric phenomena”.
