The Committee on Judicial Policy recognized the draft law on amendments to several legislative acts of Ukraine re simplifying the procedure of state registration of sole proprietors’ entrepreneurial activity termination as non-contradicting to the provision of the Constitution of Ukraine

The bill (Reg. No. 2409) was elaborated in order to simplify procedures used when terminating sole proprietors’ entrepreneurial activity. The explanatory note reads that adoption of the bill will create conditions under which, the procedure of terminating sole proprietors’ entrepreneurial activity will be carried out for 1 day; it will reduce the time limit for bringing creditor’s claims; and it will also raise Ukraine in the world rankings and increase investment attractiveness of Ukraine.    

It was stressed that the Central Scientific Experts Committee of the Verkhovna Rada of Ukraine Secretariat made several remarks in its conclusions, particularly on contradiction of the bill’s provisions to articles 13 and 42 of the Constitution of Ukraine.

Analyzing the draft law, the Committee proceeds from the assumption that legal basis and guarantees of the entrepreneurship, as well as the rules of competition and norms of antimonopoly regulation are determined exclusively by the laws of Ukraine (article 92 of the Constitution of Ukraine).
