The Verkhovna Rada of Ukraine adopted the Resolution “On the preliminary adoption of the bill on amendments to the Constitution of Ukraine re strengthening guarantees of judges’ independence”

The bill (Reg. No. 2522a) suggests make the following amendments to the Constitution of Ukraine:

stipulate in part three of article 55 the right of each person to fair and public consideration of a case within a reasonable time by independent and impartial court, established by the law;

amendments to article 85 and 125 suggest establish that determination of the network of judges, their establishment, reorganization and liquidation shall be carried out by adopting the respective law;  

amendments to articles 106, 126 and 128 suggest refine the procedure of appointing and dismissing judges;

amendments to article 122 exclude the provision on the term of tenure of the Prosecutor General;

amendments to article 125 suggest empower the Supreme Court with the authority to secure equal implementation of provisions of Ukrainian legislation by all courts of general jurisdiction;

amendments to article 126 establish that sanction for detention or arrest of a judge can be issued by the Higher Council of Justice at the motion of the Higher Qualification Commission of Judges;  

final and transitional provisions of the bill include provisions designed to solve organizational and other issues that may arise, in case the bill is adopted. The bill stipulates that the law comes into force ninety days after it is published, except for the provisions pertaining to the authority of the Higher Council of Justice to give consent to take in custody or arrest a judge, etc.
