The Committee on Judicial Policy recognized the bill on amendments to several legislative acts of Ukraine (re guarantying citizens’ right to address international human rights protection organizations) as corresponding to the provisions of the Constitution of Ukraine

The bill (Reg. No. 2306) aims at guarantying the right of the citizens of Ukraine to appeal the UN Committees on protection of human rights, which shall enable the citizens to more efficiently protect their own rights. The task of the bill is to ensure functioning of the international mechanism for protection of human rights at national level.  

The bill suggests supplement the respective provisions of the Criminal Procedure Code, the Code of Administrative Proceedings, the Economic Procedure Code, the Civil Procedure Code and the Law “On the Court System and the Status of Judges” with a provision, under which the fact of breach of international obligations, when processing the case in the court, that was determined by the respective UN Committees is a separate reason for reconsideration of courts’ judgments by the Supreme Court of Ukraine.

Following the opinion of the Ministry of Justice of Ukraine, practice of cooperation between Ukraine and the UN Human Rights Committee is viewed as acceptable and positive.

The Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariat made a number of remarks and suggestions to the bill are not reasonable and premature. Thereat, the opinion of the Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariat has no remarks to the bill in regard to its unconstitutionality.
