The Committee on Judicial Policy recommends that the Parliament should recommit the draft law on moratorium on compulsory collection of any sums under the consumer credit contracts, apart from loan principal and interest debt

The bill (Reg. No. 2278a) aims to support borrowers under consumer credit contracts, who found themselves in a difficult situation in the result of a failure to meet contractual obligations.

Committee members drew attention to the fact that the bill suggests prohibit execution of separate court judgments without day, which contradicts the right to court protection, provided by article 55 of the Constitution of Ukraine, as well as the principle of compulsory execution of court judgments throughout Ukraine (part five of article 124).

Apart form this, the people’s deputies noted that provisions of the bill do not correspond to the principle of legal certainty, which is a part of the principle of the rule of law, guaranteed by article 8 of the Constitution of Ukraine.
