The Committee on the Rule of Law and Justice recommends that the Parliament should recommit the draft law on amendments to several legislative acts of Ukraine re securing the right to consider a complaint in the cassational court

The bill (Reg. No. 2709) aims at excluding the possibility of unjustified refusal to consider civil and criminal cases on the part of the Higher Specialized Court, as well as refusal to consider cassation appeal on the part of the Higher Administrative Court. 

The bill suggests exclude clause 5 from part four of article 328 of the Civil Procedure code and from part five of article 214 of the Code of Administrative Proceedings.

It was noted that the amendments suggested do not contradict the provisions of the Constitution of Ukraine.

Upholding the bill, Committee members, however, made several remarks to it.
