The Committee on Judicial Policy recommends that the Parliament should include into the agenda the draft law on amendments to the Constitution of Ukraine regarding strengthening guarantees of judges’ independence and refer it to the Constitutional Court for conclusions regarding compliance with requirements of articles 157 and 158 of the Constitution of Ukraine

During the meeting of the Committee, the bill (Reg. No. 2522a) was referred for improvement of the provisions of the Constitution of Ukraine and strengthening of the present guarantees of judges’ independence that will give an opportunity to change the present procedure for judges’ appointment and dismissal, to reduce the role of the political bodies in this process, and it will allow to delegate authorities concerning resolving issues connected with judges activity to the jurisdiction of bodies, mostly composed of judges.        

 

It is suggested to amend the Constitution of Ukraine.

People’s deputies also stressed that during the preparation of the bill such recommendations of the Committee of Ministers of the Council of Europe were taken into account: No. 94 (12) “Independence, efficiency and role of judges”; CM/Rec (2010)12 of November 12, 2010, certain provisions of the Convention of Human Rights and fundamental freedoms, recommendations of the European Commission “For Democracy through Law” (Venice Commission).
