The Committee on the Rule of Law and Justice does not uphold the draft law on the procedure of granting a pardon by the President of Ukraine

The bill (Reg. No. 2130a) determines the order of granting a pardon by the President of Ukraine in line with clause 27 of part one of article 106 of the Constitution of Ukraine.

The Committee noted that “the suggestion to establish the order of granting a pardon by the President of Ukraine in the separate law is inexpedient and contradicts the principles of legislative techniques”. 

The people’s deputies drew attention to the fact that the Constitution of Ukraine is the Main Law of the state and unites the group of norms with the highest judicial power. Thus, under clause 27 of part one of article 106 of the Constitution, the President of Ukraine grants a pardon and under part three of the abovementioned article, he issues decrees and orders on the basis and in order to implement the Constitution of Ukraine.

Apart form this, parliament members stressed that basic provisions and concepts of pardon are stipulated in articles 85 and 87 of the Criminal Code.
