The Committee on Judicial Policy recognized the draft law on amendments to the Criminal Executive Code of Ukraine (re ensuring the right of convicted to use mobile communication in penitentiary systems) as non-contradicting to the provisions of the Constitution of Ukraine

The bill (Reg. No. 2022) was elaborated in order to improve detention conditions of convicted and increase guarantees of adhering to their rights while they serve a sentence, and to establish conditions for humanizing execution of punishment. It is suggested entitle convicted with the right to use mobile communication by making respective amendments to the articles 107 and 110 of the Criminal and Executive Code of Ukraine. 

In view of the fact that the Verkhovna Rada of Ukraine is the only legislative body in Ukraine, one of the powers of which is to adopt laws (article 75, clause 3 of part one of article 85 of the Constitution of Ukraine), making of the abovementioned amendments to the applicable legislation corresponds to the provisions of the Constitution of Ukraine.
