The Committee on Economic Policy recommends that the Parliament should adopt as a basis the draft law on amendments to several legislative acts of Ukraine re normalizing mandatory state registration of property rights to immovable property and their encumbrance

The bill (Reg. No. 2523) suggests refine mechanism of state registration of property rights to immovable property and their encumbrance.    

It is suggested supplement article 182 of the Civil Code of Ukraine with a caution under which the right to ownership and other property rights to immovable property, as well as encumbrance, creation, devolution and termination of rights are subject to state registration in cases provided by the law. Respective amendments are to be made to part 1 and 3 of the Law “On State Registration of Property Rights to Immovable Property and Their Encumbrance”.

Under the bill, property right to using (rent and lease) a building or any other permanent structure (or part of it), arising on the basis of rent (lease) agreement and concluded for the period of not less then three years, is subject to compulsory state registration.

Apart from this, it is suggested supplement article 794 of the Civil Code of Ukraine with a new part.
