The Committee on the Rule of Law and Justice does not uphold the draft law on amendments to article 5 of the Law “On Court Fees” (re supplementing the list of privileged categories (State Inspection of Ukraine for Consumers’ Rights Protection)

The bill (Reg. No. 2714) suggests amending clause 21 of part one of article 5 of the Law “On Court Fees” in order to exempt the State Inspection of Ukraine for Consumers’ Rights Protection and its territorial bodies from paying court fees in issues pertaining to the authorities of these bodies.   

It was noted that the Central Scientific Experts’ Office of the Verkhovna Rada of Ukraine Secretariat in its conclusion made a number of essential remarks and denies exemption of bodies of state authorities from paying the court fee.

Committee members believe that adoption of the abovementioned bill should be preceded by a detailed analysis that would allow clearly specify the exhaustive list of all bodies of state power entitled to such privileges, as well as the category of suits that shall exempt them from paying the court fee when submitted to the court.
