Mykola Tomenko prevailed in Four-Year Legal Proceedings with Leonid Chernovetskyi

 

The Supreme Court of Ukraine dismissed the cassation petition of Kyiv mayor Leonid Chernovetskyi to Mykola Tomenko, Deputy Chairman of The Verkhovna Rada of Ukraine, regarding protection of business reputation and dissemination of misleading information.

 

Thus, on November 3, 2006, People´s Deputy M.Tomenko claimed that family members of Kyiv mayor Leonid Chernovetskyi controlled all the land issues, influenced the public utility enterprises, etc. In response, Leonid Chernovetskyi appealed to the court with a demand to find this information misleading.

 

Obolon district court of Kyiv dismissed the appeal (resolution of February 21, 2007). The Appellate Court of Kyiv also dismissed the appeal (resolution of November 19, 2007). Having dismissed the appeal of Leonid Chernovetskyi, the Supreme Court passed a final resolution on the case that has been lasting for four years.

 

Commenting on the court resolution, the Deputy Chairman of The Verkhovna Rada of Ukraine stated that it was important and illustrative as a test case in the public discussion of activity of the public figures and politicians. He sent the copies of the materials to People´s Deputy Yu.But and journalist of Channel 5 O.Snitsarchuk, as "these materials set a test case for the legal scrutiny of similar cases."  

 

Mykola Tomenko is satisfied that four-year legal proceedings confirmed the rightness of his actions that drew attention to the importance of corruption counteraction in the capital.
