Adopted as a basis the Draft Law No. 5090 "On Amendments to the Budget Code of Ukraine Concerning the Settlement of Budget Relations during the Implementation of Agreements Concluded within the Public-Private Partnership, including Concession Agreements"
The draft law proposes to regulate the procedure for financing expenditures for the benefit of a private partner / concessionaire under a public-private partnership agreement, including a concession agreement, in accordance with the laws of Ukraine "On Public-Private Partnership", "On Concession".
The draft law proposes to amend the Budget Code of Ukraine, in particular:
- introduce the right to make long-term obligations within the PPP by managers of budget funds, which are state partners (concessionaires) in accordance with the agreement concluded within the PPP, including the concession agreement;
- set requirements for the total annual amount of long-term liabilities under the PPP (concession);
- to provide for the allocation of funds of the State Road Fund for the payment for operational readiness of public roads of state importance, built under the contract concluded under the PPP, including the concession agreement;
- to settle concession payments.
