During the meeting, the Committee members considered the draft Law on Amendments to the Criminal Procedure Code of Ukraine on the introduction of the information and telecommunication system of pre-trial investigation (No. 5246).
The draft law was submitted by the President of Ukraine and defined as urgent.
The draft law was reported by the Minister of Justice Denys Malyuska. He noted that this is "the modern draft law aimed at the introducing of information and telecommunication system of pre-trial investigation in the criminal process, which will solve several tasks in the criminal process."
The draft law provides for supplementing the Criminal Procedure Code of Ukraine with provisions that propose to establish the legal basis for the use of information and telecommunications system of pre-trial investigation in the activities of participants in criminal proceedings.
The bill, in particular, provides:
- functional purpose of the information and telecommunication system of pre-trial investigation;
- access to materials stored in the information and telecommunication system of the pre-trial investigation;
- the possibility of integration of the information and telecommunication system of pre-trial investigation with others information, information and telecommunication systems in cases provided by law.
The Minister of Justice noted that the adoption of this bill will create a legal basis for the introduction and operation of information and telecommunications system of the pre-trial investigation, storage of information in criminal proceedings and reducing the volume of paperwork in pre-trial investigation.
Chairperson of the subcommittee Maksym Pavliuk reported on the decision of the Subcommittee, which proposes to the Committee to support the bill. He also noted that the draft law aims to digitalize the pre-trial investigation.
The Committee decided to recommend to the Verkhovna Rada to adopt the draft No. 5246 as a basis and in general. The decision was supported by 21 members of the Committee.
