The law amended the Law of Ukraine No. 3176 “On Public Procurement”, which states that: - this Law shall not apply if the subject of procurement is natural gas, the purchase of which is carried out by natural gas market entities on trading platforms, the operation and management of which is provided by operators of trading platforms operating in accordance with the gas transmission system code;
- This Law shall not apply to customers operating in certain areas of management in addition to cases where the subject of procurement is natural gas, which is purchased by the gas transmission system operator to perform balancing actions or by the customer of transportation services to balance its portfolio;
- This Law shall not apply to customers operating in certain areas of management in addition to cases where the subject of procurement is natural gas, which is purchased by the gas transmission system operator, gas storage operator and gas distribution system operators to ensure their own economic activity (including for own production and technical needs, cost recovery and production and technological costs).
The law stipulates that a gas exchange that ensures the operation and management of a trading platform in accordance with this Law must ensure compliance with the requirements set for trading platforms, including the gas transmission system code.
