The Committee on Legal Policy considered the bill on the implementation of the European Court of Human Rights decisions

During its online meeting, The Committee on Legal Policy considered the draft Law No. 4048 “On Amendments to Certain Legislative Acts Concerning the Implementation of Decisions of the European Court of Human Rights”. It is also related to the draft Law No. 4049 “On Amendments to the Code of Administrative Offenses of Ukraine, the Criminal Code of Ukraine and the Criminal Procedure Code of Ukraine on the Implementation of Decisions of the European Court of Human Rights.”
 
The draft laws propose to amend four pieces of legislation in order to implement several decisions of the European Court of Human Rights. The proposed changes concern the possibility of replacing the sentence of persons sentenced to life imprisonment with temporary imprisonment and provide for further integration into society of such persons. The draft law also provides for the convict to be given the opportunity to get acquainted with electronic copies of the materials of the criminal proceedings after the court decision enters into force.
 
In addition, the draft law proposes to amend the Law on Transport, which stipulates that strikes may be applied at transport enterprises in order to resolve collective labor disputes (conflicts).
 
During the discussion, MPs stressed the need to clearly define the criteria and grounds for changing the sentence for life imprisonment. The Committee decided to recommend to the Verkhovna Rada to adopt the draft Law No. 4048 in the first reading as a basis.
