The Committee on Environmental Policy, Use of Natural Resources and Elimination of Consequences of Chornobyl Disaster recommends that the Parliament rejects the Bill on Amendments to Article 29 of the Law "On Protection of Population and Territories from Emergency Situations of Technical and Natural Character" (re rendering Assistance to the Families of the Victims)

The Bill (Reg. No. 1062) "authorizes the Cabinet of Ministers of Ukraine to submit to court the appeals on declaring the natural persons dead, provided they are missing under the death-threatening circumstances or those that give reason to presuppose their death from a certain accident".  

 

During the discussion the People´s Deputies emphasized that "the said commission is not under the authority of the Cabinet of Ministers, pursuant to the Law "On the Cabinet of Ministers of Ukraine".

 

The Committee members stated that "protection of population and territories from emergency situations includes actions appertaining to prevention of and response to the emergency situations, and elimination of their aftermath. However, neither constituent of the said protection includes declaring persons dead".

 

Pursuant to the Procedural Civil Code of Ukraine, the person whose body was not found in the process of elimination of disaster aftermath can de declared dead according to the court´s decision.
