Draft law No.3584 offers to amend the Code of Administrative Offences of Ukraine and the laws of Ukraine "On road traffic," "On local self-government in Ukraine", "On insurance" and "On the national police."
In particular, the draft law offers to amend the Code of Administrative Offences of Ukraine as follows:
- To provide for the possibility of bringing to administrative responsibility legal entities and individuals to whom the vehicle is registered or who imported the vehicle registered outside of Ukraine, into its territory, or persons owning and / or using vehicles on the basis of lease or rent contracts, etc. for violation of the rules of parking, stopping and standing of vehicles, detected by photo / video traffic enforcement cameras (amendments to Article 14-2);
- To change the objective element of the offence stipulated in Article 152-1 and toughen penalties for its commission;
- To amend Articles 218 and 219, which determine government bodies authorized to consider cases on administrative offenses stipulated in Items 1 and 3 of Article 122, Article 152-1 of the Code of Administrative Offences of Ukraine;
- To supplement the Code with Article 265-4 "Temporary detention of vehicles by inspectors of parking area."
The amendments to the above laws offer to expand:
- The competence of local councils of various levels as to vesting parking space inspectors with authorities to consider cases on administrative violation of the rules of parking, stopping and standing of vehicles; and also provide for the establishment of an automated system of control over the parking space;
- The list of drivers’ obligations;
- Exclusive competence of village, town and city councils, as well as own (self-government) powers of village, town and city councils in the field of transport;
- The list of compulsory insurance types in Ukraine;
- Powers of the police in the field of information and analytical support, and the list of information and information resources, to which the police has direct online access.
Having analyzed the draft law, the Committee members noted that the proposed amendments will allow introducing in Ukraine a civilized comfort system of the vehicle parking, which is based on European practices and balance the interests of the local community and motorists.
