Draft law No. 3769 submitted by the President of Ukraine and determined by him as urgent, prescribes for introduction of the institute of electronic writ proceedings that will reduce load on the judicial system of Ukraine, ensure timely and efficient protection of violated rights and interests of individuals and legal entities, decrease costs from the state budget for maintenance of judicial authorities.
The draft law also proposes to determine that economic cases at the electronic writ proceedings will be referred to jurisdiction of the Commercial Court in Chernihiv region, and civil cases – to jurisdiction of the Brovary District Court in Kyiv region.
Appropriate amendments were proposed to the Economic Procedure Code, the Civil Procedure Code, Laws “On Access to Court Decisions”, “On the Judicial System and Status of Judges”, “On Enforcement Proceedings", “On Court Fee”.
During the discussion, members of the Committee drew attention to a significant number of cases in Ukraine concerning recovery of funds against contractual obligations, as well as excessive workload of judicial authorities.
People's Deputies believe that introduction of the European practice of electronic writ within the framework of civil and economic proceedings will simplify and accelerate the process of judicial protection of violated rights and lawful interests of individuals in the recovery of undisputed monetary debts.
