The draft law offers to amend Articles 81, 39 and 41 of the Law of Ukraine "On prosecutor's office," under which prosecutor general of Ukraine will appoint and dismiss deputy prosecutor general / head of the Specialized Anticorruption Prosecutor's Office; first deputy head of the Specialized Anticorruption Prosecutor's Office and deputy head of the Specialized Anticorruption Prosecutor's Office; while head of the Specialized Anticorruption Prosecutor's Office will appoint and dismiss head of subdivision of the Specialized Anticorruption Prosecutor's Office and deputy head of the subdivision of the Specialized Anticorruption Prosecutor's Office.
In compliance with the draft law, head of the Specialized Anticorruption Prosecutor's Office obtains the right to autonomously recruit and dismiss employees of the Specialized Anticorruption Prosecutor's Office, who are not prosecutors.
The draft law also offers to elaborate requirements to members of the tender commission, in particular, the those should be persons having considerable experience in preventing and combating corruption. The head of the tender commission should be remarkable and authoritative expert having considerable experience, interest or known for his deeds in combating corruption.
The tender commission will recommend Specialized Anticorruption Prosecutor's Office's head one candidacy to each of the following seats — first deputy and deputy heads of the Specialized Anticorruption Prosecutor's Office. Later the head of the Office will submit them for consideration by the Prosecutor General's Office of Ukraine.
The prosecutor general of Ukraine will have the right to reject the candidacy for seats in the Specialized Anticorruption Prosecutor's Office in compliance with requirements of the legislation. Prosecutor general will have an opportunity to exercise that right not more than twice in a row for each of the administrative positions.
