In particular, the Law rules that the preparation for privatization and sale of G-group facilities can be provided with the help of advisors selected through tenders in compliance with the order set by the Cabinet of Ministers of Ukraine.
The tender selection of the advisors takes place in correspondence with the principles of competitiveness, equality of rights, availability, publicity and transparency, independence of tender commission members. The criteria set by the Cabinet of Ministers of Ukraine have to envision, in particular:
competence of advisors in fulfillment of similar tasks;
possibility of central representation and attraction of other advisors;
qualification, experience, knowledge, and skills;
advisor-offered methodology of preparation for sale; sale strategy, material support and organization of projects;
advisor-offered terms for preparation for sale and sale of facility subject to privatization.
Attraction and determination of advisors for preparation for privatization and sale of facilities are provided under respective decision of the Cabinet of Ministers of Ukraine. The Cabinet of Ministers sets the following major duties for the advisors:
gathering of information and examination of economic, technical and financial indicators of enterprise's activity;
bringing of major indicators of accounting statement of the enterprise into line with the standards of accounting;
holding of audit;
estimation of investment attractiveness of the enterprise and possible ways to raise it, ways to restructure receivables;
organization of independent assessment;
preparation of documentation on enterprise in compliance with requirements of the legislation on protection of economic competition;
measures on finding potential investor.
To enhance protection of national interests in the process of reformation of ownership relations it is offered to prevent privatization of enterprises by purchasers from the countries declared aggressor-states by the Verkhovna Rada of Ukraine.
The Law was adopted taking in account remarks announced during the discussion.
