The legislative act perfects the mechanism of formation of the major indicators of state defense order.
The Law rules that "during the planning of the defense order, state customers base their position on the fact that the procurements (supplies) of the products, works and services of defense purposes are conducted only in compliance with the defense order."
In extraordinary circumstances, in conditions of special period, in case of introduction of state of emergency, holding of anti-terror operation or emergence of critical situations that endanger the national security of Ukraine, if necessary, the procurement (supply) of products, works and services of defense purposes are provided beyond the state defense order."
In compliance with the Law "in conditions of special period, in case of introduction of state of emergency, holding of anti-terror operation, the major indicators of the defense order can include other military property that ensures functioning of the Armed Forces of Ukraine and other military formations established in compliance with laws of Ukraine, if their procurement is of state secret."
In compliance with the Law, "the order of making price for products, works and services of defense purposes is set by the Cabinet of Ministers of Ukraine if the selection of executors of supplies (procurements) of such products, works and services is rendered beyond competitive procedures."
The Law of Ukraine "On state defense order" has been respectively amended.
Respective draft law was registered under No. 2090а.
