Verkhovna Rada of Ukraine adopts Law "On amendments to some laws of Ukraine concerning peculiarities of state registration of local self-government bodies as legal entities"

The Law regulates relations arising in connection with the state registration of a newly formed local self-government body or formed as a result of merger, consolidation, division or transformation, as a legal entity; eliminates the shortcomings of legal regulation of the issue of succession of unified territorial communities, their village, town and city councils and executive committees of such councils; brings in line with the legislation a procedure of reorganization of local self-government bodies in the process of a voluntary unification of territorial communities, etc.

The Law, in particular, defines that the unified territorial community is a successor of all property, rights and obligations of territorial communities that have unified, from the date of the entry into office of village, town or city council, elected by such unified territorial community.

In the case of the unification of all territorial communities of the same district into one unified territorial community all the property in joint ownership of territorial communities of such district is a communal property of the unified territorial community, and rights and obligations related to this property belong to the unified territorial community from the date of the entry into office of village, town or city council, elected by such unified territorial community.

According to the Law, budgets of territorial communities that have unified, are performed separately till the end of the budget period, taking into account peculiarities.

Till the end of the period of separate execution of the budgets of territorial communities that have unified, functions of key administrators of budget funds of territorial communities that have unified, are performed by corresponding budget institutions represented by village, town or city mayor, elected by a unified territorial community, other heads of budgetary institutions.

The Law was adopted with technical and legal amendments.

Respective draft law was registered under No. 3106.
