The Committee on Legislative Support of the Law-Enforcement Activity is getting prepared to the Parliamentary Discussion of the Bill Amending Several Acts of Legislation of Ukraine concerning the Extent of the Property Damage and Rate of Penalties in Criminal Legislation

The Bill (Reg. No. 3739), submitted by the Cabinet of Ministers of Ukraine, aims at establishment of adequate sum of money that will be used for qualification of property crimes and administrative offences.

Amendments to Paragraph 22.5 of Article 22 of the Law of Ukraine "On Income Tax of Natural Persons" envisage that minimum non-taxable income of the citizens for the regulations of both administrative and criminal legislation regarding qualification of crimes and offences, and other legislative acts, should equal 17 Hryvnias.   

The Bill is based on the principle of social equity, which states that each criminal and legal sanction should correlate with the degree of social peril of the action described by the Law, and should be coordinated with sanctions established for committal of other crimes of equal degree. 

Adoption of the proposed amendments will enable the court to impose fine as a penalty, alternative to confinement, which will correspond to the degree of social danger of the crimes, qualification of which presupposes the extent of inflicted harm.
