The Law creates possibilities for proper formation and execution of budgets of united territorial communities and provides effective functioning of budgetary institutions and high quality of services in all population centers of a district, including territorial communities that do not merger.
To this end the Law introduces amendments to Articles 75, 93, 99, 122, Chapter VI "Final and transitional provisions" of the Budget Code of Ukraine through:
- regulation of certain question of procedures of formation of draft budgets of united territorial communities and control over observation of the budget legislation in the part of inter-budgetary relations / amendment to Section 9, Article 75 and Section 2, Article 122 of the Code/;
- prolongation of the effect of Unit 20, Chapter VI "Final and transitional provisions" of the Code to the end of 2016 that allows outlays from budgets of villages, towns of district subordination for maintenance of junior schools, cultural centers, clubs and libraries with specification regarding a district council's resolution to transfer such outlays on motions from village and town councils / amendments to Unit 20, Chapter VI of the Code "Final and transitional provisions";
- defining for the period of creation of united territorial communities peculiarities of forming and execution of budgets of territorial communities in case a law on State budget of Ukraine is not adopted by December 1 and in case of failure to adopt a respective local budget by the start of the new budget period and to regulate a question of execution of budgets of territorial communities and district budgets in districts where united territorial communities are partially created pursuant to the law and perspective plan of formation of territories of communities / new Unit 38, Chapter VI of the Code "Final and transitional provisions";
- correction of provisions regarding transfer of funds between local budgets by withdrawing excessive specification and list of local budgets during horizontal equalizing of tax capacities of budgets / amendments to Articles 93 and 99 of the Code/;
- introduction of obligation of district councils to transfer from common property to property of united territorial communities of budgetary institutions located on their territory pursuant to the separation of outlays between the budgets defined by the Code / new Unit 39, Chapter VI of the Code "Final and transitional provisions"/.
