Draft law (No. 3407) suggests termination of Law of Ukraine "On rehabilitation of trust in the judiciary of Ukraine" which pursues the aim of rehabilitation of the confidence of the society in the judiciary through dismissal of judges for rulings affecting constitutional rights and freedoms of citizens and the aim of fighting corruption in the system of courts of general jurisdiction.
In compliance with the Law of Ukraine "On rehabilitation of trust in the judiciary of Ukraine" the temporary special commission was established to check judges of general jurisdiction. Materials of the commission regarding the checks of judges are being stored in compliance with the order provided for storing documents at the High Council of Justice.
The temporary special commission has submitted to the High Council of Justice 46 findings on violations of the oath by judges. To date, a mere of three of them have been considered by the High Council of Justice.
Paragraph 2, Section 2, Article 7 of the Law of Ukraine "On rehabilitation of trust in the judiciary of Ukraine" envisages that findings of the temporary special commission regarding violations of the oath by judges shall be considered by the High Council of Justice.
The Committee members believe that in case of termination of the Law of Ukraine "On rehabilitation of trust in the judiciary of Ukraine" the findings of the temporary special commission regarding violations of the oath by judges will stop being compulsory for consideration by the High Council of Justice.
