The draft law offers to set legal and organizational principles of state regulation of external labor migration and social protection of Ukrainian citizens, who temporarily worked or still work abroad (labor migrants), and their family members.
In compliance with the draft law, the effective Ukrainian legislation on external labor migration comprises terms of the Constitution of Ukraine, this Law, other legislative acts that regulate relations in the field of external labor migration, as well as international agreements of Ukraine, whose bindingness obtained respective approval of the Verkhovna Rada of Ukraine.
A central executive body is offered to be the major body in the system of central executive bodies responsible for formation and realization of state policy in the labor and social sector, employment of the population and labor migration.
The draft law also offers to determine the rights of labor migrants to proper labor conditions, social protection and family reunion.
The draft law envisions that "the rights of labor migrants, in particular, to proper working conditions, remuneration of labor, vacation and social protection, are regulated by the laws of the resided country and international agreements of Ukraine.
Labor migrants and their family members have right to take part in compulsory state social insurance during their labor activity abroad in compliance with the Ukrainian legislation."
The document also offers to set state guarantees as to provision of social services and assistance to labor migrants.
The draft law obliges the state to assist reintegration of labor migrants and their family members with the society after their return to Ukraine through provision of social services in compliance with the Law of Ukraine "On social services."
The draft law also offers to set state control and responsibility for violation of legislation on external labor migration.
In compliance with draft law, "central and law enforcement bodies, Security Service of Ukraine take all possible measures within their competence to prevent illegal external labor migration and human trafficking.
Economic entities providing mediation services in employment abroad, mass media organizations, other enterprises, institutions and organizations or individuals, who spread unfair information linked to external labor migration, bear responsibility in compliance with the law."
