Verkhovna Rada adopts draft law "On amendments to Penal and Civil Codes of Ukraine" (as to improvement of special seizure institution to remove risks of corruption during seizure) as a basis

The draft law aims to remove risks of corruption during special seizure.

The draft law offers to envision an opportunity to apply special seizure as a measure of criminal-legal nature for all crimes.

Respective amendments are offered to Articles 96-1 and 96-2 of the Penal Code of Ukraine.

The draft law also offers to amend sanctions of a number of Articles of Special Section of the Penal Code of Ukraine, under which the seizure of articles obtained by criminal means is replaced with special seizure of the said articles.

The document offers to introduce amendments to Articles 330 "Acquisition of property right by a bona fide  acquirer of property alienated by a person who did not have the right to" and 354 "Seizure (Confiscation)" of the Civil Code of Ukraine.

In compliance with the Articles:

1) a bona fide acquirer cannot be a person, who acquired the property knowing that such property was acquired by criminal means;

2) seizure and special seizure can be applied only as a sanction for commission of certain crime.

Respective draft law was registered under No. 2541а.
