Verkhovna Rada Committee for State Building, Regional Policy and Local Governing recommends Parliament send draft law on introduction of amendments into Law of Ukraine “On local self-government in Ukraine” (on specification of mechanism of execution of specific authorities) for adaptation

  During the consideration of the draft law No. 1473, members of the Committee were informed that the Verkhovna Rada Committee for Combating Corruption noted that the draft legislative act does not contain corruption factors — the draft act corresponds to the demands of the anticorruption legislation; the Verkhovna Rada Committee for Legal Policy and Justice noted that the draft law does not contradict provisions of the Ukrainian Constitution. Specialists of the Association of Ukrainian Cities, all-Ukrainian association of local self-government bodies, expressed negative remarks as for the providing extra authorities to village, town and city heads and proposed to adopt the draft law as a basis following results of its consideration in first reading. Representatives of the Association of Small Cities of Ukraine, all-Ukrainian non-government organization, stressed that the draft law fully meets the needs of Ukrainian towns.

At the same time, people's deputies have taken in account conclusions of the Institute of Law of the Verkhovna Rada of Ukraine, as well as of the Scientific-Research Institute of State Building and Local Self-Government of the National Academy of Legal Sciences of Ukraine. In compliance with the conclusions the experts agreed with the necessity for perfection of the Law of Ukraine “On local self-government in Ukraine” and noted that expansion of the exclusive competence of village, town, and city councils would enhance legal, organizational and material-financial guarantees of local self-government bodies, would facilitate improvement of the mechanism of execution of the principle of unification of local and nation-scale interests. Therefore, members of the Committee agreed with remarks, in particular, as to adding Section 4, Article 42 of the Law of Ukraine, which in opinion of the experts provides village, town and city heads with authorities able to motivate corrupt actions. Besides, the scientists consider that proposals for Article 76 of the Law of Ukraine limit authorities of executive bodies in the field of cooperation with local self-government bodies.
