The following laws were adopted with consideration of proposals of the President of Ukraine:

 

"On Industrial Parks"

 

The Law determines the main principles, conditions and procedures of establishment and functioning of industrial parks aimed at economic development and increasing competitiveness of territories, intensification of investment and innovative activity, creation of new jobs, and development of modern production and market infrastructure.

 

Having considered the Law "On Industrial Parks" adopted by the Verkhovna Rada of Ukraine on March 22, 2012, the President of Ukraine suggests that it cannot be signed due to the fact that the law contradicts general principles of establishment of ministers and other bodies of executive authorities as well as the division of powers between them; it does not correspond to the norms of Commercial Code regarding the requirements for approval of sample agreement on the establishment and operation of industrial park; it establishes regulation of land relations different from the one that was set by the Land Code; it prevents creation of industrial parks in areas that have not been used before; the law includes inner contradictions between the norms that regulate the issue of determination of the functional purpose of the industrial park; private enterprises are made unequal with regard to public utilities, etc.

 

People?s deputies took into consideration all the remarks of the President of Ukraine. In particular, it is stipulated that the authorized state body is the state body of executive power that provides for the implementation of state policy in the sphere of investment and management of national projects, etc.

 

 The respective bill was registered under No.8396.

 

 "On Administrative Services"

 

The law determines legal principles of realization of rights and interests of natural persons and legal entities in the sphere of administrative services provision.

 

People?s deputies supported a number of proposals of the President of Ukraine.

 

 The respective bill was registered under No. 9435.

 

 The following laws were adopted in entirety:

 

"On Employers' Organizations, Their Unions, the Rights and Guarantees of Their Activity"

 

The law suggests establishing the peculiarities of legal regulation; basis for creation and activity of employers? organizations and unions of employers? organizations; the main principles of their cooperation with governmental and local authorities, trade unions and citizens' associations.

 

 The bill introduces special legal regime for registration of employers? organizations and their unions, normalizes their participation in the social dialogue at different levels, etc.

 

 The document amends the Laws "On Public Associations", "On the Fundamentals of State Monitoring (Control) over Business Activities", "On State Registration of Legal Persons and Natural Persons Entrepreneurs", "On the Vocational and Technical Education", "On Higher Education", "On State Order to Meet Priority State Needs", and "On Trade Unions, their Rights and Guarantees of Activity".

 

 The respective bill was registered under No. 10108.

 

"To Amend the Law of Ukraine "On the State Budget of Ukraine for 2012" (re additional expenses on state safety)   

 

The law is aimed at ensuring reorganization and roundout of subdivisions of the Foreign Intelligence Service (within the maximum complement of the Service determined by the law) under the Decree of the President of Ukraine as of 27.04.2012 No. 292-4т/2012.

 

 The respective bill was registered under No. 10600.

 

"On Amendments to Certain Legislative Acts of Ukraine regarding Payment for Accession to the Networks of Natural Monopolies Entities"

 

The Law sets the criteria of presence (lack) of technical capacity to attach the customers? electrical installations. The body in charge of state supervision in the sphere of electrical energy shall issue an expert review of this matter.

 

 To protect consumers? rights, the Law sets out the maximum term of delay in accession to the networks of natural monopolies entities, namely, not more than three years. Three years is a maximum period to finance the necessary measures for accession.

 

 

According to the Law, legal relations connected with attachment of customers? objects to electrical and gas networks is regulated by the legislation which was valid before the entry into force of the current law and only if technical conditions for interconnection to the electric or gas networks were issued to the customer before January 1, 2013 and the construction of such objects was started before July 1, 2013.

 

The law comes into force on January 1, 2013.

 

 The respective bill, with certain changes was registered under No.9011.

 

"To Amend the Law "On the Cabinet of Ministers of Ukraine" (regarding Patronage Service)

 

The document reads that patronage services of the first deputy prime minister of Ukraine and deputy prime ministers of Ukraine are formed as a part of Secretariat of the Cabinet of Ministers of Ukraine.

 

The primary purpose of the bill is to support efficient implementation of tasks and duties of deputy prime ministers of Ukraine.

 

The respective bill was registered under No. 9224.

 

"On Housing and Public Utility Services" regarding improvement of housing fund management system and settlement of specific issues in the sphere of housing and public utility services"

 

The Law authorizes the owners of residential and non-residential property in the house to independently select the method of house management, choose the providers of housing and public utility services, and settle other issues by introducing the mechanism of decision-making at the general meeting of the owners. The bill also defines the status of housing management providers, and their rights and obligations connected with housing management services.

 

The Law determines the status of the agent of house management services, his rights and obligations, establishes the basis for creation of competitive environment in the sphere of public utility services preserving current infrastructure, provides equal conditions for the activity of entities of all forms of ownership as well as conditions for the preservance of existing enterprises of state and municipal ownership.

 

The respective bill was registered under No.8391.

 

To Amend the Law of Ukraine "On the State Budget of Ukraine for 2012" (re payment to scientific and teaching staff involved in Independent External Assessment)

 

The Law increases the amount of general state fund budget by UAH 16mln (including UAH 11,88mln for salary).

 

State budget expenditures will be covered by the equal increase of the planned amount of state budget fund profits through the net profit income from the state unitary enterprises as well as dividends from business entities? shares.

 

To implement the abovementioned suggestion the Law includes amendments to the Appendix No.1 "Revenues of the State Budget of Ukraine for 2012" and Appendix No.3 "Distribution of expenditure of the State Budget of Ukraine for 2012" of the Law "On the State Budget of Ukraine for 2012".

 

The respective bill, with certain changes, was registered under No.10635.

 

"To Amend Several Legislative Acts of Ukraine to Delineate the State-Owned and Municipal Lands"

 

The document determines that the target purpose of especially valuable lands can be changed only for construction of the objects of national significance, roads, power transmission and communication lines, pipelines, drainage and irrigation canals, geodetic points, housing, social-cultural facilities, oil and gas wells, and industrial facilities.

 

Under the law, attribution of especially valuable lands to state or municipal ownership, determined in clauses "а" and "б" of part one of article 150 of the Code, to lands of other categories shall be done upon agreement of the Verkhovna Rada.

 

 The Law determines also that transfer of state-owned land plots into municipal ownership or vice versa is performed under the decisions of respective executive bodies or local self-government bodies.

 

 The respective bill, with certain changes, was registered under No. 10043.

 

"To Amend the Land Code of Ukraine and other Legislative Acts regarding Land Survey Works Connected with Determination and Change of Boundaries of Administrative-Territorial Units"

 

The Law is to improve legal regulation of relations connected with determination and change of boundaries of administrative-territorial units; specifies the powers of the Verkhovna Rada of the Autonomous Republic of Crimea, regional and district councils to determine and change the boundaries of villages, townships, as well as the procedure of agreement upon the respective land survey projects between the respective bodies of local self-government and executive power; determines the procedure for settling disputes connected with agreement upon land survey projects of administrative-territorial units by establishing conciliatory commissions of respective level depending on the category of administrative-territorial units.

 

 The Law was adopted under the new title: "To Amend the Land Code of Ukraine and other Legislative Acts regarding Land Survey Works connected with Determination and Change of Boundaries of Villages, Townships, Cities and Regions"

 

The respective bill was registered under No.10042.

 

"On Aquaculture"

 

The Law determines the basics of operation and state regulation of aquaculture as a separate kind of agriculture in the system of agroindustrial production that ensures targeted use of fishery objects (their parts) for obtainment of useful agricultural products (fish and other aquatic biological resources), preservation of natural diversity and increase of water biological resources by their artificial reproduction and growing in completely or partially controlled conditions.

 

The document contains also proposals in regard to the procedure of relations of the governmental bodies and local self-government bodies with economic agents that operate in aquaculture in internal water bodies, internal sea waters and territorial sea of Ukraine.

 

 The respective bill was registered under No.9571.

 

 "On Amendments to Clause 46 of the Law "On Motor Transport" (re bidders for transport operators)

 

The legislative act suggests a new version of the article 46 "Competition for transportation of passengers on the bus route of public use" of the Law "On Motor Transport".

 

 

 

To streamline licensing procedures in the sphere of passenger transportation, the Law shortens the list of documents which the transport operator has to submit to the tender committee to participate in the tender for passenger transportation on the general-purpose bus route. Thus, bidders for transport operators do not have to submit the certificate proving that technical condition of the bidder?s buses comply with the transportation conditions and the conclusion of the State Motor Vehicle Inspectorate of the Internal Affairs Ministry confirming that the bidder meets the requirements of normative-legal acts on traffic safety.   

 

 The Law is to improve passenger service, and cut down the number of licenses.

 

The respective bill was registered under No.9126.

 

"To Implement the Program of the Global Fund to Fight AIDS, Tuberculosis and Malaria in Ukraine"

 

The document contains: the procedure for implementation of programs of the Global Fund in Ukraine and their coordination on the part of the state; tax and customs duty exemptions for operations and goods paid for by the Fund; determination of responsibility for target use of funds, etc.

 

The respective bill was registered under No. 10121.

 

"To amend the Law of Ukraine "On Natural Monopolies" (re stimulated regulation)

 

The Law introduces a new method of regulation of the activity of subjects of natural monopolies stimulated regulation of prices (tariffs) for their goods.

 

The implementation of provisions of the Law will create conditions for transition from expendable to stimulated methods of governing the subjects of natural monopolies, which will allow for significant improvement of their financial condition and increase of their investment attractiveness. At the same time, consumers should also benefit from transition to stimulated regulation, as the companies will be motivated to cut down on the inefficient expenses and increase the quality of services provided.

 

 The current law is supplemented by the provision according to which "stimulated regulation is the state price (tariffs) regulation for goods of subjects of natural monopolies".

 

 The Law stipulates that the decision to implement stimulated regulation in the respective sphere is taken by the body performing state regulation of the activity of subjects of natural monopolies, as agreed by the central body of the executive power responsible for implementation of the state price policy.

 

 The respective bill was registered under No.10338.

 

"On governmental procurement of postal services, postage stamps, and stamped envelopes"

 

Under the Law, governmental procurement of postal services, postage stamps, and stamped envelopes is subject to the procedure of procurement from one participant in line with clause 39 of the Law "On Governmental Procurement."

 

Within one working day since it was resolved to apply the procedure of procurement from one participant, the customer shall publish the information about the procedure of procurement from one participant in the state-owned official printed media on governmental procurement and on the website of the authorized body on governmental procurement. Under the bill, winner of the procurement procedure shall be selected within three working days since the information about the procedure of procurement from one participant was published in the state-owned official printed media on governmental procurement.

 

The agreement on procurement of postal services, postage stamps, and stamped envelopes is drawn up in a written form in line with the Civil and Economic Codes of Ukraine and with account for the laws "On Governmental Procurement" and "On Postal Service."

 

 The respective bill was registered under No.9519.

 

 "To Amend Several Laws of Ukraine regarding State Procurement"

 

The legislative act amends the laws "On Government Procurement" and "On Scientific and Scientific-Technical Activity" to introduce the procedure of purchasing the service concerning delivery of research work, research and technology works, and research and design works which were selected by the Cabinet of Ministers under the established order. 

 

The respective bill was registered under No.9451.

 

 "On National Target Program of Transferring Dormitories into Ownership of Territorial Communities for 2012-2015"

 

The legislative act adopted the Program of transferring dormitories into ownership of territorial communities and attracts funds of the State Budget, other sources of financing, technical and labor resources of territorial communities and economic agents that own or posses the dormitories.

 

The program contains provisions on mechanisms, procedure and sequence of actions of the parties participating in the process of delivery-takeover of objects of the right of state and communal ownership, as well as laws "On Execution of Housing Rights of Dormitory Residents" and "To Amend and Supplement Several Legislative Acts of Ukraine (re improvement of legal regulation of execution of housing rights of dormitory residents)."

 

According to the Law implementation of the Program will result in transferring 1058 state-owned dormitories with total area of 2457.82 thousand square meters.

 

The respective bill was registered under No.10226.

 

"To Amend Several Laws of Ukraine regarding Production and Use of Motor Fuels with Bio-Components"

 

The law determines that bioethanol content in motor petrol produced and sold on the territory of Ukraine shall be: at least 5% (volume) in 2013; not less than 7% from 2016.

 

The respective amendments are introduced into the Laws "On Alternative Fuels" and "On Entrepreneurship".

 

The respective bill was registered under No. 10572-1.

 

"To Amend Article 23 of the Law of Ukraine "On Joint-Stock Companies (re Securities of the Public Company 'Ukrhidroenerho')"

 

The law amends article 23 of the Law "On Joint-Stock Companies" allowing paying for the shares of ‘Ukrhidroenerho? Public Company by state bonds of Ukraine.

 

 The respective bill was registered under No. 10611.

 

 "To amend the Law of Ukraine "On the State Budget of Ukraine for 2012" (re issue of bonds of inner government loan to public joint stock company "UkrHidroEnergo")

 

The Law provides the Cabinet of Ministers with the right to issue bonds of inner government loans within the levels set in Annex No.2 "Financing the State Budget of Ukraine for 2012" to the Law "On the State Budget of Ukraine for 2012" in the amount of UAH 1 000 000 with further acquisitions to state ownership in exchange for these bonds additionally issued shares of public joint stock company "UkrHidroEnergo".

 

The respective bill is registered under No.10612.

 

Four bills on ratification were passed.

 

Eight bills were adopted as a basis.

 

A number of resolutions on appointment and dismissal of judges and celebration of anniversaries were passed.

 

A number of legislative documents were recommitted and sent for repeated first reading, and some were rejected.

 

161 deputy inquiries were voiced.
