The bill (Reg. No. 4298a) was elaborated in order to fulfill clause 9 of the resolutive part of the Decision of the European Court of Human Rights in the case “Oleksandr Volkov vs Ukraine” of January 9, 2013, under which Ukraine should secure the quickest possible reinstatement of O.Volkov in office as a judge of the Supreme Court of Ukraine.

The bill suggest excluding the words “the Supreme Court of Ukraine Volkov Oleksandr Fedorovych” from the Resolution of the Verkhovna Rada of Ukraine “On Dismissal of Judges” of June 17, 2010, and reinstate O.Volkov in office as a judge of the Supreme Court of Ukraine.

The Committee Chair S.Kivalov informed that Ukraine fails to fulfill the Decision of the European Court of Human Rights in the case “Oleksandr Volkov vs Ukraine”, though different bills on reinstatement of the judge in office were considered in the Parliament, however, were not adopted, despite the positive opinions of the specializing committee.
