During the
discussion of the bill (Reg. No. 2504a), the people’s deputies paid attention
to the fact that “in the course of prejudicial and judicial inquiry on the
basis of the Criminal Procedure Code, which came into force on November 19,
2012, numerous disputes between the participants of criminal proceedings arise
which concern receiving a copy of the report by a person owning a house or other
possessions, and in case of their absence – by other present person, as
presentation of such a copy of the resolution in article 236 of the Criminal
Procedure Code is not stipulated.”
It was mentioned that the bill suggests amend the Criminal Procedure Code concerning presentation of a copy of the search report, particularly, to supplement article 236 with chapter nine.
The parliamentarians stressed that leading experts from the National University “Odesa Law Academy”, National Academy of Legal Sciences, National University “Yaroslav the Wise Law Academy of Ukraine” and the Legislation Institute of the Verkhovna Rada of Ukraine upheld this bill and provided their suggestions.
