The Committee on Judicial Policy recognized the draft law on amendments to the Law “On the Procedure of Compensation for Damage Caused to a Citizen by Illegal Actions of Bodies that Carry Out Operational-Search Activity, Bodies of Pretrial Investigation, Bodies of the Prosecutor’s Office and the Court” re enlarging the list of grounds for damage compensation as corresponding to the provisions of the Constitution of Ukraine

The bill (Reg. No. 3392) establishes that damage caused to a citizen in the result of “illegal inactivity of investigation or prosecutor officer that lies in failure to record criminal offence in the single registry of pretrial investigations after the respective claim or statement on criminal offence or illegal decision of investigation or prosecutor officer to terminate pretrial investigation or commence criminal proceedings was received”, should be compensated.

In view of the fact that the Verkhovna Rada is the only legislative body in Ukraine one of the duties of which is to adopt laws (article 75, clause 3 of part one of article 85 of the Constitution of Ukraine), the suggested amendments to applicable legislation correspond to the provisions of the Constitution of Ukraine.
