The Committee on Judicial Policy recommends that the Parliament should adopt as a basis the draft law on amendments to article 778 of the Civil Code of Ukraine (re improving provisions in the sphere of lease (rent)

According to the explanatory note, the bill (Reg. No. 3070) is aimed at protecting lessor’s ownership rights, particularly, it is suggested to establish that leasee’s actions towards improving the object of a lease agreement do not entail joint ownership rights of such object.

The bill stipulates introduce a new version of chapter four of article 778 of the Civil Code.

The Committee members suggest establish that the owner of an object, created from a leased object, as a result of its improvement or other remaking approved by the lessor, is a lessor unless otherwise stipulated by law or agreement. According to the Committee members, it is necessary to determine the conditions for compensating the cost of improvement an object.
