The Committee members considered four bills: on amendments to several legislative acts of Ukraine re treatment of the convicted abroad (Reg. No. 2453а); on amendments to article 84 of the Criminal Code of Ukraine re possibility of treatment of the sentenced to imprisonment abroad (Reg. No. 3461); on prohibition of selective justice and removing obstructions for signing the Association Agreement between Ukraine and the EU, as well as the EU member-states (Reg. No. 3479); on amendments to several legislative acts of Ukraine (re humanization of legislation on pre-trial detention and guaranteeing constitutional rights and freedoms for people placed under detention, sentenced to imprisonment, and convicted undergoing medical treatment in health care institutions outside places of execution of punishment) (Reg. No. 3526).      

As it was mentioned during the meeting of the Committee, the bill (Reg. No. 2453а) suggests amend article 153 of the Criminal Executive Code of Ukraine, articles 135, 194, 280, 536, 539, 539-1 and 540 of the Criminal Procedure Code in order to regulate grounds and procedure of “suspended sentence in connection with illness of the convicted requiring treatment abroad.”

The alternative bill (Reg. No. 3461) suggests introduce a new version of chapter 2 of article 84 of the Criminal Code of Ukraine.

The alternative bill (Reg. No. 3479) suggests introduce in Ukraine mandatory amnesty or free pardon for people to whom “acts of selective justice and violation of Ukraine of article 18 of Convention for the Protection of Human Rights and Fundamental Freedoms were applied.”

The bill also stipulates establish in a legal system of Ukraine such institute as amnesty for a specific person (individual amnesty). Moreover, it is suggested to “apply complete individual amnesty to Tymoshenko Yulia Volodymyrivna.”

The alternative bill (Reg. No. 3526) suggests amend the Criminal Executive Code and the Law “On Pre-Trial Detention”.

Following the results of the discussion and vote, the Committee members adopted the decision to recommend that the Verkhovna Rada, following the results of their consideration in the first hearing, should recommit all the bills.
