The bill (Reg. No. 2351 refined) suggests return to national property “unlawfully appropriated pre-school educational institutions of national and communal types of ownership that were transferred for use, not according to the intended purpose, to other people or organizations, corresponding to the procedure established by law.”
During the meeting the Committee members stressed the opinions of the Central Scientific Experts Office of the Verkhovna Rada of Ukraine Secretariat according to which the bill should be rejected.
The experts emphasized that according to clause 7 of article 92 of the Constitution of Ukraine the Verkhovna Rada establishes legal regime of ownership exclusively by adopting respective laws. Thus, the issue of returning premises of pre-school educational institutions of national and communal types of ownership to national (communal) property should be settled by adopting a respective law, not a resolution of the Verkhovna Rada of Ukraine.
