In the result of consideration by the President of Ukraine the following law was adopted:

“On amendments to Final Provisions of the Law “On the Regulation of Urban Development” re suspension of the ban on land acquisition” with consideration of proposals of the President of Ukraine

The Law was adopted by the Verkhovna Rada of Ukraine on September 21, 2013 (Reg. No. 2363-1).

The legislative act moves the time of entry into force of parts 3 and 4 of article 24 of the current law from 1 January 2013 to 1 January 2015. These norms ban distribution (provision) of land from state or municipal ownership or use to natural and legal persons for urban needs in the absence of zoning plan or detailed plan of the territory and change of the purpose of land that does not meet the zoning plan.

The President of Ukraine thinks that the Law can not be endorsed because it “bans provision of urban conditions and limitation of the competent authorities of the urban development and architecture, it also bans the effect of the ban on land acquisition and change of their purpose in case of absence of the zoning plan and detailed plan of the territory for all urban centers of Ukraine, except Kyiv.”

According to the president of Ukraine, this will lead to violation of the constitutional norms “regarding the equality before the law of all subjects of rights to property, the ensuring of the state protection of rights of all subjects of rights to property and to economic management, social orientation of economy, equality before the law for all citizens, impossibility of privileges, restrictions based on residence” (articles 13, 24 of the Constitution of Ukraine) and will also have negative impact on the economic development of Kyiv City.

The President of Ukraine thinks that suggested approach to the regulation of land relations only in Kyiv is unjustified, thus he suggests exclude the words “except Kyiv City” in the respective clauses of the Law.  

The respective bill was registered under No. 2363-1.

 

The following laws were adopted in entirety:

 “On amendments to several legislative acts of Ukraine (re payment of court fee)”

The bill stipulates amendments to the Code of Ukraine on Administrative Offences and to the Law of Ukraine “On Court Fee” that set new rates of court fee in cases of administrative offences and increase certain rates of court fee.     

The respective bill was registered under No. 0973.

 

“On amendments to the Law of Ukraine “On Military Duty and Military Service” (re performance of military duty)  

The legislative act specified certain provisions of the Law “On Military Duty and Military Service”, set certain issues on the performance of military duty and doing military service by citizens; it also specified the beginning of the military service for the citizens called in compulsory military service; set time limit of arrival at regional (city) military commissariat of persons dismissed from the military service for including them into the registration for the military service; set the terms of doing military service and reasons for dismissal from the military service of the military men in case of a special period, etc.           

The respective bill was registered under No. 0909.

 

“On amendments to article 98 of the Constitution of Ukraine” (re powers of the Accounting Chamber) 

According to the law, the Accounting Chamber exercises control on receipt of funds to and use of funds from the State Budget of Ukraine. Organization, powers and operating procedures of the Accounting Chamber are defined by the law.   

The respective bill was registered under No. 2049.

 

 “On amendments to the Customs Tariff of Ukraine, approved by the Law of Ukraine “On the Customs Tariff of Ukraine” (new version)

The document stipulates:

- that the country’s legal framework should be brought in accordance with the system of the generally recognized norms of international law, particularly by creating the Customs Tariff of Ukraine based on the new version of Ukrainian Classification of Goods for Foreign Economic Activity, formed on a basis of the Harmonised Commodity Description and Coding System of 2012;

- that tariff commitments achieved in the negotiations process, connected with Ukraine’s accession to the WTO (that are registered in the Protocol on Ukraine's accession to the WTO for 2013), should be fulfilled.  

The law also stipulates that the full pay of the import duty through the whole new version of the Customs Tariff should be reduces; the rates of import duty on certain types of metal scrap should be increased; zero duty rate on polyvinylchloride should be determined.      

The respective bill was registered under Reg. No. 2105a.

 

“On approval of the decision of the President of Ukraine on sending the national contingent for Ukraine's participation in the UN Stabilization Mission in the Democratic Republic of Congo”

The legislative act adopts the decision of the President of Ukraine in a form of the respective Decree on sending the national contingent for Ukraine's participation in the UN Stabilization Mission in the Democratic Republic of Congo. Total number of military men is approximately 300, Ukraine’s participation in the Mission will last within the time limits established by the United Nations Security Council.    

The law establishes that cost funding, related to the participation of Ukraine in the UN Stabilization Mission in the Democratic Republic of Congo, will be provided from the State budget of Ukraine with further cost reimbursement by the United Nations Organization. 

The respective bill was registered under Reg. No. 3264.

 

“On ratification of the Council of Europe Framework Convention on the Value of Cultural Heritage for Society”

According to the Convention, the Parties agree to: recognise that rights relating to cultural heritage are inherent in the right to participate in cultural life, as defined in the Universal Declaration of Human Rights; recognise individual and collective responsibility towards cultural heritage; emphasise that the conservation of cultural heritage and its sustainable use have human development and quality of life as their goal; take the necessary steps to apply the provisions of this Convention concerning:

the role of cultural heritage in the construction of a peaceful and democratic society, and in the processes of sustainable development and the promotion of cultural diversity;

greater synergy of competencies among all the public, institutional and private actors concerned.

According to this document, the Parties agree to promote an understanding of the common heritage of Europe, which consists of: a) all forms of cultural heritage in Europe which together constitute a shared source of remembrance, understanding, identity, cohesion and creativity, and b) the ideals, principles and values, derived from the experience gained through progress and past conflicts, which foster the development of a peaceful and stable society, founded on respect for human rights, democracy and the rule of law.

The respective bill was registered under Reg. No. 0031. 

 

“On ratification of the Agreement (in the form of exchange of letters) between Ukraine and NATO on Ukraine's participation in Operation Ocean Shield”

According to the Agreement, Ukraine’s national contingent will support the Operation Ocean Shield that aims at helping to deter, disrupt, defend and protect people from pirate attacks and armed assaults at sea by carrying out naval operations near the Horn of Africa and demonstrating commitment in the campaign against piracy. It also includes involving the Armed Forces of Ukraine. This operation complies with the principles of the UN Charter and goals set by the UN Security Council Resolutions 1816, 1836, 1846, 1851, 1897 and 2020, which call all states for cooperation, particularly within bilateral and multilateral arrangements and agreements, to prevent and stop acts of piracy.

During the participation of its forces in the operation, Ukraine will cooperate with the headquarters of the NATO Operation Ocean Shield (Northwood) through the headquarters of the Navy Command of the Armed Forces of Ukraine (Sevastopol).

The warship and Ukraine’s personnel will undergo certification within the preparation for the participation in Operation Ocean Shield and will participate in training and practice. Main principles and requirements of such preparation will be defined by SACEUR and the General headquarters of the Armed Forces of Ukraine (KYIV) or their authorized representatives.

“On amendments to the Law of Ukraine "On ratification of the European Convention on Cinematographic Co-Production”

The legislative act establishes the Ukrainian Film State Agency as a competent authority for giving cinematographic works a status of a co-production work in Ukraine.   

The respective bill was registered under No. 0034.

 

“On ratification of the European Convention for the protection of pet animals”

The Convention is aimed at ensuring the protection and humane treatment of pet animals. The documents defines basic principles for animal welfare, conditions of their keeping, breeding and training, establishes the age limit of acquisition of pet animals, restrictions on their use for commercial purposes, legal order for the establishment and operation of animal shelters, restrictions for use of pet animals in advertising and entertainment, acceptable cases of pet animals surgeries and their killing, measures that can be applied towards stray animals, particularly to decrease their population, and exceptions for their capture, keeping and killing, etc.       

The respective bill was registered under No. 0032. 

 

“On the unified state demographic register and identity documents that prove citizenship of Ukraine, identity or special status” re settling the issue of driving licence validity of sample forms approved by the authorities of the Union of Soviet Socialist Republics  

According to the document, driving licences that were issued using a sample form approved by the executive authorities of the Union of Soviet Socialist Republics, can be replaced with a licence of a new sample at the wish of the owner and in cases stipulated by the current legislation.

The respective bill is registered under No. 2633-1.

 

“On amendments to article 59 of the Law of Ukraine “On nuclear energy use and radiation safety” re customs clearance of radioactive materials

The legislative act supplements article 59 of the current legislation with part seven.

The law was adopted with the new name “On amendments to article 59 of the Law of Ukraine “On nuclear energy use and radiation safety” re crossing the customs border of Ukraine and customs clearance of radioactive materials”

The respective draft resolution is registered under No. 1185.

 

“On amendments to several laws of Ukraine on the social protection of the homeless”

The law establishes that the organization of providing social services for the homeless, taking measures, according to the law, in order to prevent homelessness of the people belong to the competence of executive bodies of city, township and village councils.

The respective draft resolution is registered under No. 0869.

 

Several resolutions on appointment and dismissal of judges, on celebrating anniversaries and memorable dates, etc. were adopted.  

 

Several documents were adopted in the first hearing, recommitted for the repeated first hearing, sent for refinement, rejected.  

 

259 deputies’ inquiries were announced.
