The bill (Reg. No.2779) is aimed at
the observance of requirements of clause 3 and part 1 of clause 49 of the
Constitution of Ukraine.
Pursuant to the Constitution of Ukraine, an individual and his/her health is defined as the supreme social value. Pursuant to part 1 clause 49 of the Fundamental Law, each citizen has the right for health protection. According to the requirements of part 3 clause 22 of the Constitution of Ukraine, in the course of adoption of new laws or introduction of amendments to the effective laws, the existing rights and liberties of the citizens of Ukraine shall not be restricted.
N. Korolevska, Committee Chairperson, emphasised, "To meet the requirements of the Law "On Provision of the Health Well-Being of the Citizens", specialists of the state health and disease control establishments exert disease control to support the adequate level of protection against the harmful influence of environmental factors. The state disease control and state control over the quality of medicines are exerted via inspections of the business entities or their subdivisions."
The Law "On the Fundamentals of State Supervision (Control) over the Economic Sector" sets the specific order of state supervision over the business entities and their subdivisions. Thus, it makes the state disease and epidemic control, and the state control over the quality of medicine more complicated, reducing their efficiency in view of the compulsory notification of the date, the time and the place of the inspection.
The People´s Deputies admitted, "There is a possibility for the business entities or their subdivisions to evade the compulsory control, whereas the above-mentioned factors make it impossible to get objective results of the inspection."
The parliament members are convinced that the applicable version of clause 2 of the Law "On the Fundamentals of State Supervision (Control) over the Economic Sector" restricts the content and scope of the constitutional rights and liberties of the citizens of Ukraine.
